TERMS & CONDITIONS
Section 1: Introduction and Acceptance of Terms
These Terms & Conditions (the “Terms”) govern your use of the website operated by Macte Marketing Agency, which is operated by Maria Seltsova (autónomo), based in the European Union (“we”, “us”, or “our”), and any interaction you may have with us through this website or related communication channels. By accessing or using this website, scheduling a consultation, or expressing interest in our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with these Terms, you should not access or use our website or engage in preliminary consultation activities. These Terms apply solely to your browsing and informational use of the website and any pre-contractual discussions. Any paid services provided by Macte Marketing Agency will be governed by a separate written agreement, proposal, or statement of work mutually agreed upon by both parties. We reserve the right to modify these Terms at any time. Any changes will take effect upon publication on this page, with the “Last updated” date revised accordingly. Continued use of the website after changes are made constitutes acceptance of the updated Terms.

Section 2: Scope of Services and Subcontracted Work
2.1 Scope of Services
Macte Marketing Agency provides strategic marketing consulting, brand positioning and development, performance marketing direction, digital growth strategy, analytics evaluation, creative direction, and related advisory services. Depending on the specific engagement, services may include marketing audits, go-to-market planning, branding and rebranding strategy, campaign optimization consulting, fractional CMO services, and coordination of design, media, and implementation work.
The services described on the website are illustrative and non-binding. They do not constitute a formal offer. Any professional engagement with a client will be governed by a separate agreement, proposal, statement of work, or contractual document that outlines specific deliverables, timelines, fees, and obligations.
2.2 Collaboration with Subcontractors and External Providers
Certain aspects of service execution may be performed in collaboration with subcontractors, independent consultants, partner agencies, or third-party service providers (collectively, “Subcontractors”). These may include, without limitation, specialists in performance advertising, SEO, design, creative production, media buying, development, analytics, or branding.
Where Subcontractors are involved:
  • Macte Marketing Agency may act as a strategic lead or coordinating agent.
  • Each Subcontractor remains legally responsible for their own deliverables and professional conduct.
  • We do not assume liability for delays, errors, or omissions caused by third-party providers beyond our reasonable control.
  • Client approval of service commencement constitutes acceptance that Subcontractors may be engaged when necessary.
  • Upon request, we may disclose whether Subcontractors are involved in a specific engagement, unless confidentiality agreements prevent disclosure.
2.3 No Automatic Guarantee of Engagement
Contacting us, requesting information, booking a free consultation, or discussing a potential project does not create a binding agreement or obligation on either party to proceed further. A professional engagement will only be established when both parties expressly agree to proceed under a written contract or confirmed commercial arrangement.

Section 3: Use of the Website
3.1 Acceptable Use
You agree to use this website solely for lawful purposes and in accordance with these Terms. You must not use the website in any way that:
  • Violates applicable laws or regulations;
  • Infringes upon the intellectual property rights of Macte Marketing Agency or any third party;
  • Interferes with or disrupts website functionality or security;
  • Attempts to gain unauthorized access to our systems or those of any third party;
  • Transmits malicious code, including viruses, worms, or spyware;
  • Is intended to harm the reputation or operations of Macte Marketing Agency.
3.2 No Reliance on Website Content
Information, case studies, or examples displayed on the website are for general informational and illustrative purposes only. They do not guarantee comparable outcomes or create any representation of future performance.
3.3 No Automatic Legal or Contractual Relationship
Visiting the website, viewing service descriptions, or participating in an exploratory consultation does not establish a contractual or advisory relationship. Only a mutually executed written agreement can establish a binding professional engagement.

Section 4: Consultations, Bookings, and Pre-Contract Interactions
4.1 Free Consultations and Discovery Calls
We may offer complimentary discovery or strategy calls to assess potential client needs, discuss goals, and determine whether a collaboration is feasible. These calls are non-binding and do not constitute legal or contractual commitments by either party.
4.2 Use of Calendly or Other Scheduling Platforms
If a consultation is scheduled through Calendly or another third-party booking system, the date and time selection serves only as an appointment request. We reserve the right to accept, reschedule, or decline any consultation at our discretion. By scheduling a consultation, you acknowledge that such booking does not guarantee future engagement or service delivery.
4.3 No Professional Advice During Preliminary Calls
Any guidance or insights provided during exploratory calls are general in nature and should not be considered final professional advice or a definitive strategic recommendation. Full recommendations or strategic frameworks will only be developed under a formal engagement agreement.
4.4 Pre-Contract Assessment and Approval
We reserve the right to assess the suitability of a project and may decline to enter into a formal engagement if the fit is not appropriate or feasible.

Section 5: Intellectual Property
5.1 Website Content
All content on this website, including but not limited to text, graphics, logos, images, layouts, concepts, design elements, downloadable materials, and case study summaries, is the intellectual property of Macte Marketing Agency or used under appropriate license. Such content is protected under applicable copyright, trademark, and intellectual property laws. You may view the content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, republish, or create derivative works from any content on this website without our prior written consent.
5.2 Branding and Trademarks
The name Macte Marketing Agency, associated logos, taglines, and other brand identifiers are trademarks or trade names owned by us. They may not be used by third parties without express written authorization.
5.3 Client Materials and Ownership
If a client provides materials (e.g., brand assets, logos, internal data) for purposes of service delivery, such materials remain the property of the client. We will only use them as necessary to fulfill our contractual obligations.
5.4 Project Deliverables (if applicable)
Ownership of final deliverables, such as strategy documentation, reports, creative direction outlines, or marketing structures, will be governed by the terms of a separate written agreement. Unless otherwise agreed, intellectual property rights in preliminary concepts, strategic frameworks, methodologies, and internal processes remain the property of Macte Marketing Agency.
5.5 Use of Samples and Case Studies
Unless otherwise agreed in writing, we may reference anonymized or approved results, insights, or project outcomes in general case studies, educational content, or marketing materials, provided that confidentiality is maintained and no proprietary client data is disclosed without consent.

Section 6: Limitation of Liability and Disclaimer of Results
6.1 No Guarantee of Specific Outcomes
Marketing performance, conversion rates, brand engagement, advertising results, or return on investment (ROI) are influenced by numerous external factors beyond our control, including but not limited to market conditions, competition, client responsiveness, internal execution, budget allocation, and product/service quality. Accordingly, Macte Marketing Agency does not guarantee specific results, performance levels, sales outcomes, or increases in revenue or engagement.
6.2 Advisory Nature of Services
Unless explicitly stated in a written agreement, our services are provided on a consulting, strategic, or advisory basis. Clients are responsible for implementing recommendations and for any business decisions made based on our insights or strategies.
6.3 Third-Party Platforms and Tools
We are not responsible for any errors, interruptions, downtime, policy changes, penalties, or functionality limitations caused by third-party platforms (including but not limited to Google, Meta, LinkedIn, Calendly, Tilda, or advertising networks).
6.4 Subcontractors and External Providers
As noted in Section 2, certain services may be performed by Subcontractors or independent service providers. Macte Marketing Agency acts as a coordinating agent but is not legally liable for direct damages, delays, or misconduct caused by such third parties unless otherwise agreed under a written contractual framework.
6.5 Limitation of Liability
To the fullest extent permitted by law, Macte Marketing Agency and its operators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:
  • Use or inability to use the website;
  • Reliance on pre-contractual advice or marketing insights;
  • Delays, errors, or omissions in third-party services or subcontractor performance;
  • Loss of revenue, business opportunities, profits, or data.
Where liability cannot be excluded by law, our total aggregate liability shall be limited to the amount directly paid to us by the client in connection with the specific service giving rise to the claim.

Section 7: Third-Party Links and External Platforms
Our website may include links to third-party websites, platforms, scheduling tools, or resources, including but not limited to Calendly, analytics dashboards, advertising platforms, or social media pages.
7.1 No Control Over Third-Party Content
We do not control or endorse third-party websites or services and are not responsible for their content, privacy practices, terms of use, or accuracy.
7.2 User Responsibility
If you choose to access third-party websites or engage with services provided by external platforms, you do so at your own risk. It is your responsibility to review and comply with the terms of those third-party platforms.
7.3 Third-Party Policies Apply
Any personal data provided through third-party platforms (e.g., booking a meeting via Calendly, contacting us via social media, submitting information through external forms) is subject to the privacy and data handling practices of those respective service providers.

Section 8: Suspension, Modification, and Termination of Website Access
We reserve the right, at our discretion and without prior notice, to:
  • Modify, update, or discontinue any part of the website;
  • Restrict access to the website or specific features;
  • Suspend or terminate access for users who violate these Terms or engage in unlawful or harmful activity.
We do not guarantee uninterrupted website availability and are not liable for any unavailability, delay, or modification in access due to maintenance, technical issues, or third-party service failures.

Section 9: Changes to the Terms
We may update or amend these Terms & Conditions from time to time to reflect changes in legal requirements, service offerings, or business practices. Any changes will take effect immediately upon publication on this page, unless otherwise stated. The “Last updated” date at the top of the policy will indicate when revisions were made. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. If you do not agree with any modifications, you must discontinue your use of the website.

Section 10: Governing Law and Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any disputes arising out of or relating to the use of this website, pre-contractual communications, or these Terms shall be subject to the exclusive jurisdiction of the courts located in Spain, unless otherwise required by applicable law.
